1. Benelux: Belgium, Netherlands and Luxemburg

The Netherlands is part of the Benelux (Belgium, The Netherlands and Luxembourg) concerning trademark and design matters. The Benelux is part of the European Community and is also part of the Madrid system (Agreement and Protocol).

The Benelux Office for Intellectual Property is a very efficient government organization, which means that it is possible to register a trademark within even 3 to 4 months.

A Benelux trademark may thus be an interesting option for companies to be the basis for their International trademark registration (WIPO system), as the client can be sure that the basic trademark has been registered and it is still possible to request priority.

3. International

A Benelux trademark is in general the most efficient way to register a basic registration which is necessary for an International trademark application through the system of WIPO.

It is also possible to use a EU-trademark as a basis of the International Registration. The European Community has however only signed the 'Protocol' treaty.

Through the system of International Registration of WIPO it is possible to register a trademark in several countries or regions of the world. The respective countries or regions can be designated when applying for the International trademark. There is a tariff for the International trademark application, which provides entrance to the system, and a fee for the respective countries or regions. In order to apply for a trademark through this system it is necessary that the respective trademark is registered (or filed) in one country / region which is a member of this system, this is the basic registration. The system has so called 'Agreement Countries' and 'Protocol Countries', depending on which treaty the respective country has signed regarding the system. In general the tariff for filing a trademark in an 'Agreement Country' is lower.

Merk-Echt can handle International trademark applications through WIPO which are based on either a Benelux trademark or a EU-trademark.
